Non threshold injury

New South WalesMotor vehicle accidents

An injury serious enough, under the New South Wales scheme, to allow a claim for damages on top of statutory benefits.

New South Wales motor accident claims distinguish threshold injuries, broadly soft tissue and minor psychological injuries, from non threshold injuries. Only a non threshold injury opens the door to a damages claim, which is assessed under guidelines published by SIRA.

This definition is specific to New South Wales. The same term can work differently in another state, and the glossary marks each entry accordingly.
