The compulsory third party insurer of the vehicle at fault. The claim is made against the insurer, not the driver.
Every registered vehicle carries CTP insurance, and the insurer of the vehicle most at fault answers the claim. Where the vehicle cannot be identified or was unregistered, the nominal defendant stands in its place. In Queensland the insurers are licensed by MAIC; in New South Wales by SIRA.
