Statutory claim

QueenslandWorkers compensation

The no fault stage of a Queensland workers compensation claim: weekly payments, treatment and a lump sum for permanent impairment.

The statutory claim does not require proof that the employer was at fault. It runs from acceptance until the worker recovers or the injury is assessed as stable, when the WC insurer offers a lump sum based on the degree of permanent impairment. Accepting that lump sum can affect the right to bring a common law claim, so advice before accepting is important.

This definition is specific to Queensland. The same term can work differently in another state, and the glossary marks each entry accordingly.
