Section 39

New South WalesWorkers compensation

The provision that stops New South Wales weekly payments after a set number of years unless the worker’s whole person impairment exceeds a threshold.

Under section 39 of the Workers Compensation Act 1987, weekly payments end after 5 years for injuries other than primary psychological injuries unless the worker has been assessed above 20%. The assessment is therefore decisive for long term weekly payments, and the timing of it matters.

This definition is specific to New South Wales. The same term can work differently in another state, and the glossary marks each entry accordingly.
