Limitation period

All statesEvery claim

The time limit within which court proceedings must be started. Once it passes the claim is barred unless an extension is granted.

Every personal injury claim has a limitation period set by legislation, and the injury schemes add earlier notice deadlines before it. The periods differ by state and by claim type, and extensions are granted only in limited circumstances. Prompt advice preserves the options; a strict timeframe set by the regulator is not something to assume can be fixed later.
