Economic loss

All statesEvery claim

Income and earning capacity lost because of the injury, past and future.

Past economic loss is the income lost between the accident and settlement. Future economic loss is the effect of the injury on earning capacity for the rest of the working life, assessed on the evidence of what the person would have earned and what they can now earn. It is usually the largest head of damages in a serious claim, and it is where the insurer argues hardest.
