Reasonable precautions

All statesPublic liability

The steps a reasonable occupier would have taken against a foreseeable risk, such as cleaning, signage, repair or inspection systems.

A public liability claim succeeds where the occupier failed to take reasonable precautions against a foreseeable and not insignificant risk. Evidence of the occupier’s cleaning and inspection systems, incident reports and CCTV is central, which is why it needs to be requested early before it is overwritten.
